These Terms & Conditions ("Terms") govern participation in the PowerPusher Upgrade & Save Event (the "Program"), a limited-time trade-in promotion offered by PowerPusher, a division of TC Nu-Star, Inc. ("PowerPusher," "we," "us"). By submitting an Upgrade & Save Conversion Form or otherwise participating in the Program, you agree to these Terms.

 

1. Promotion Period

The Program is valid on qualifying purchase orders placed between August 1, 2026 and October 31, 2026, inclusive (the "Promotion Period"). Purchase orders placed before or after the Promotion Period are not eligible. All required documentation must be submitted during the Promotion Period. PowerPusher reserves the right to close the Program earlier if program funding is exhausted (see Section 9).

 

2. Eligibility

The Program is open to end-user customers purchasing qualifying new equipment through an authorized PowerPusher distributor. Participants must:

  • Be a business or commercial entity purchasing for business use;
  • Own the trade-in equipment being replaced, free of any lien, lease, or third-party interest; and
  • Be located within the Program's eligible territory as identified at the time of order.

Employees of PowerPusher and TC Nu-Star, Inc. and their authorized distributors may be excluded from participation. The Program is void where prohibited or restricted by law.

 

3. Qualifying New Products

The Program incentive applies only to the purchase of the following new PowerPusher models:

  • Automotive Movers: 189A, 186A, NSP5A
  • Dumpster Movers: 189DM, 189DMHD, NSP5-DM

No other PowerPusher models, accessories, attachments, parts, batteries, chargers, freight, or service offerings qualify for the Program incentive unless expressly stated in writing by PowerPusher.

 

4. Incentive Amounts

Qualifying participants may receive one of the following incentives, applied as a discount toward the purchase price of the qualifying new PowerPusher unit:

  • $1,500 off — when trading in a competitive electric tugger or pusher manufactured by a company other than PowerPusher.
  • $1,000 off — when trading in an existing PowerPusher unit.

Incentive amounts are stated in U.S. dollars. Incentives are not transferable, have no cash value, and cannot be redeemed, exchanged, or refunded for cash or credit. Incentives may not be combined with any other discount, promotion, rebate, or offer unless expressly authorized in writing by PowerPusher.

 

5. Trade-In Requirements

To qualify, the trade-in unit must be an electric tugger or pusher that is owned by the participant and in service or previously in service at the participant's facility. Each trade-in submission must include a completed and signed Upgrade and Save Conversion Form including:

  • Machine make and model
  • Machine serial number and controller identifier
  • Photograph of the entire machine
  • Photograph of the serial number plate
  • Reason for replacement

Incomplete submissions will not be processed. PowerPusher reserves the right to request additional documentation to verify eligibility.

 

6. Controller Return — Required

Return of the trade-in unit's controller is a mandatory condition of the Program. Upon qualification, PowerPusher will provide a prepaid UPS shipping label to the ed user purchaser. The purchaser must remove the controller from the trade-in unit, package it, and ship it to PowerPusher using the prepaid shipping label provided.

By participating, the participant certifies that the controller submitted has been removed from the identified equipment and will not be reinstalled, resold, or transferred to another machine, and that all information provided is accurate to the best of the participant's knowledge. PowerPusher reserves the right to deny or reverse any incentive if the returned controller does not match the submitted documentation, is not received, or if the certification is found to be inaccurate.

Controllers received by PowerPusher will be destroyed.

 

7. How the Program Works

  • Step 1 — Submit. Complete the Upgrade and Save Promotion Redemption Form
  • Step 2 — Approval. PowerPusher verifies the qualifying model and, if approved, assigns the discount to the customer’s new, signed purchase order
  • Step 3 — Return the controller. PowerPusher issues a prepaid UPS label; the participant removes and ships the controller.
  • Step 4 — Release. Once the controller is received, logged, and verified, the purchase order is released for shipment.

No incentive will be honored retroactively. 

 

8. Limit — One Incentive Per Unit

One (1) incentive is available per qualifying replacement unit. Each trade-in unit may be applied only once and toward only one qualifying new unit. Trade-in of a single unit against multiple purchases is not permitted. PowerPusher reserves the right to limit the total number of incentives per customer or per location.

 

9. Limited Program Funding

Program funding is limited and is allocated on a first-approved basis while funds remain available. Submission of an Upgrade & Save Conversion Form does not guarantee an incentive. PowerPusher reserves the right to suspend, close, or terminate the Program at any time, including before October 31, 2026, once program funding has been exhausted.

 

10. Pricing, Taxes, and Fees

The incentive is applied to the unit purchase price and is exclusive of applicable taxes, freight, delivery, installation, attachments, and other charges, which remain the responsibility of the purchaser. The participant is solely responsible for any tax liability arising from participation in the Program. Final sale price, payment terms, and transaction handling are determined by the authorized distributor completing the sale.

 

11. Order Changes, Cancellations, and Returns

If a qualifying order is cancelled or returned after an incentive has been applied, PowerPusher reserves the right to reverse the incentive and invoice the applicable amount. Returned controllers will not be re-issued in the event of a cancellation.

 

12. Verification and Fraud

PowerPusher reserves the right to verify all submissions and to disqualify any participant, distributor, or submission that PowerPusher determines, in its sole discretion, involves inaccurate information, tampering, duplicate submission, or any attempt to circumvent these Terms. PowerPusher's determinations regarding eligibility are final.

 

13. Modification of Terms

PowerPusher reserves the right to modify, suspend, or terminate the Program or these Terms, in whole or in part, at any time and for any reason, without prior notice. The version of these Terms in effect at the time an order is placed governs that order.

 

14. Privacy

Information submitted in connection with the Program is collected and used in accordance with the PowerPusher Privacy Policy. Submitted information may be shared with the authorized PowerPusher distributor assigned to your territory for the purpose of fulfilling your order and providing follow-up support.

 

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to the Program shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.
